CALL TO ORDER

The meeting was called to order by John Caffrey, Chairman, September 2, 1998, at 10:04 a.m., in the First-Floor Hearing Room, 901 "P" Street, Sacramento, California.

WATER RIGHTS

2. Consideration of Proposed Order Requiring the City of Los Angeles to Implement Stream and Waterfowl Habitat Restoration Measures in the Mono Lake Basin (Water Right Licenses 10191 and 10192, Applications 8042 and 8043).
Harry Schueller, Chief, Division of Water Rights, presented the item noting staff recommended revisions (dated September 1, 1998) to the July 16 draft order. Mr. Schueller also briefly summarized significant written comments received from interested parties.

T. Birmingham, F. B. Dodge, M. Scoonover, D. Mooney, K. Bellomo, V. Cahill, R. Roos-Collins and J. Edmondson addressed the Board.

Dan Frink, Office of the Chief Counsel, responded to some of the comments.

Motion: By roll call vote the Board approved the draft order as recommended by staff, including the September 1 additional revisions, and two additional revisions: (l) page 33, first sentence, remove the word "strong"; and (2) page 43, last sentence, first full paragraph, remove the word "high". WR Order 98-05

BAY PROTECTION CLEANUP PLANS

3. Consideration of a Resolution to Adopt a Water Quality Control Policy for Guidance on the Development of Regional Toxic Hot Spot Cleanup Plans.

Craig J. Wilson, Division of Water Quality, presented the item noting revisions since the discussion at the July 8, 1998 Board meeting and the staff meeting with Department of Pesticide Regulation. Mr. Wilson also responded to comment letters.

J. M. Peltier, N. Capretz, G. Fred Lee, J. Bruns, M. Lozeau, B. Stuart, B. Jennings, K. Nakatani, A. Greenberg, J. Forrest, S. Green, K. Mannion, B. Thomas, and K. Taberski addressed the Board.

Mr. Wilson and responded to questions from the Board regarding the FED process.

Motion: By roll call vote 3-to-2 the Board adopted the resolution approving the policy and FED, as recommended by staff. Resolution 98-090
